Crematory Operator Faces More Charges

LaFAYETTE, Ga. (AP)--Authorities filed another 102 criminal charges Tuesday against the operator of a crematory where hundreds of corpses have been discovered.

Ray Brent Marsh already faced 16 counts of theft by deception for allegedly taking money for cremations he never performed at Tri-State Crematory.

The 102 theft by deception charges were filed by the Georgia Bureau of Investigation and issued in a warrant by Walker County Magistrate Judge Shelia Thompson.

The new counts were connected to 51 of the corpses found at Tri-State. For each body, one count was filed for taking money from the families and another for failing to give the ashes to the families, officials said.

So far, 339 corpses have been found on the crematory grounds, including eight found in a pit on Tuesday. Only 74 of the bodies have been identified.

Marsh's wife and sister visited him at the county jail Tuesday. Neither spoke to reporters. Marsh's attorney, Ken Poston, also refused to comment.

Gov. Roy Barnes was notified Tuesday that the Federal Emergency Management Agency will not give the state money for clean-up. FEMA Director Joe Allbaugh said ``an emergency declaration is neither appropriate nor warranted.''

Barnes has 30 days to appeal to President Bush.

Officials have said they cannot estimate the cost of the clean-up until all the bodies have been recovered, but believe it will surpass $10 million.

Also on Tuesday, the House unanimously voted to make it a felony to abandon a body intended for cremation or burial. The bill now goes to the Senate.

The latest charges against Marsh were filed just hours after a separate judge ruled Marsh could leave jail on $100,000 bond on the original 16 theft charges.

The new counts prevent his release from jail until a new hearing can be set, District Attorney Buzz Franklin said.

Meanwhile, recovery workers spent their 12th day clear-cutting the 16-acre crematory grounds.

Authorities have said it could be late summer before all the bodies are identified. Some workers are growing weary and occasionally sick as the emotional toll mounts.

``Everybody involved in this process, from the word go, is suffering some kind of emotional strain,'' said David Ashburn, the Walker County emergency director. ``It's things that you and I were never meant to be exposed to.''

Officials estimated they had searched only three or four acres of the Tri-State grounds, which comprise at least eight acres, excluding buildings and a small lake. Authorities are working on a plan to drain the lake.

Family members lined up Monday to give blood samples, hoping their DNA would help investigators identify more bodies.

Donating blood meant fresh grief for Elaine Bray of Chattanooga, Tenn., who arrived at the civic center down the road from Tri-State with a mug of small pebbles--part of which she thought were the remains of her brother, who died four years ago.

``All I wanted to do is give him a proper death,'' she said. ``This is what I got.''

Eddie Young of Crystal River, Fla., said he hoped DNA testing might tell him whether the body of his mother, who died in November, was left to decompose on the grounds of the crematory.

``I know her soul went to heaven, but to think that my mother might be out there--it's so hard to accept,'' he said. ``We had our closure through the funeral, and now it's like it's reopened.''

Here's what I don't understand. There's a church next door and people live in the neighborhood. Didn't they smell something foul? I mean 300+ bodies gotta smell pretty bad.

The second thing is, did these folks really think they'd get away with this forever. I mean, the majority of the bodies were just laying in the back of the building. Somebody was gonna see something.

I didn't even think about the smell. 300 bodies yeah I would think that would be a horrible smell.

Yeah they probably did think they would get away w/it forever. Criminals never think they are going to get caught.

I don't think it takes that much effort, but they claim was that the machine to cremate the bodies was broke. I mean, c'mon now. Either you pay to have it fixed or do like the indians do and just set a match to the bodies.

Besides the obvious, the other disturbing fact is that the cremators gave the families dirt and/or concrete as the remains of their loved ones.

Fools never think they'll be caught. My heart really aches for he families of the deceased whose loved ones remains were thrown out like trash.

The smell of formaldehyde and burning flesh is sickening so they probably never knew the difference. Formaldehyde is also a preservative and may have stagnanted the decaying process a bit. Also, your talking about 16 acres, so the closeness of the church and a strong wind blow may play factors in why it went so long without being detected. Somebody tipped off the EPA so I think someone knew soemthing.

The whole situation began when someone was walking their dog past the crematory and the dog found a skull. I think there's a lot more behind this that's not being said.

...Here this story comes that is so grotesquely ghoulish that it defies explanation. Sad that there is no justice that can compensate for such a horror. The depths of depravity astounds me. Makes me sick to think about that fool. And of course, of course! he's black!

The bodies had already been embalmed, that's why there was no smell.

You also can't just burn a body with a match in a pit or something. The moratorium heat is to an extent that it disentegrates the entire body, bones and all...plain burning would not do that.

I think the man being charged sort of inherited the problem when he inherited the business. His family had been doing this since the early 80's when he was barely a teenager. :( The machine has been broken since the early 80's.

Personally, I think that the machine broke down, they intended to fix it and passed off something other than ashes to a couple of families and got away with it, so they just kept doing it. Then once they reached a certain level there was no turning back because they were gonna be charged either way. The parents died without being found out...the son is left to take the blame and he may not even know how/when it got started. But he's at fault because the fool kept it going. He received bodies as recently as last month.

The worst thing about this whole situation besides the dead body is that the owner is a black man. To me this put another dark cloud over the African-American business community.

...when i open my shit, it will not be run like that!!! it is a shame that it is a brotha who was sloppy with his work or lack thereof...but keep in mind that the business and i'm sure the practices were passed on to him from mom and dad...wtf is up with that???:confused:

I was watching the news this morning and it was reported that the part that had gone bad in the crematory equipment cost only $160. It doesn't make any sense at all that they didn't get that fixed years ago. There has to be more to this story than just the equipment was down.

Now it's getting really bizarre.

The investigators are now saying that they've checked and the damn machine ain't even broke. WTF? WTS?

Then why ya'll didn't cremate NOBODY. Again WTF? WTS?

They've denied this fool bail because his life is in danger.
