View Full Version : Is This Legal?

We got called into a meeting today and were told that they we are now required to work 10 hours 4 days out of the month. That is 10 working hours not including lunch.
Also, we were told that since we were exempt employees we should work more than the standard 7.5 hours anyway. They said that we should finish all our work at the end of each day (i'm thinking, what will I have to do tomorrow then).
Currently I am regularly working 9.5hrs (7am-4:30p) including lunch. Sometimes I leave at 4p. So basically they want me to add another 1.5hr to my time on certain days, but I don't understand the purpose?
Is this legal for them to do?

i thought the law was you couldn't work anywhere without having atleast a 15 minute break every 4 hours, and you couldn't work past 6 hours without atleast a half hour lunch.
SOunds like they want to try flex time....we have that here
i work
week#1
mon-Thurs 7-430pm off Friday
Week#2
mon-Thursday 7-430pm Friday 7-330pm

This is common practice here in this plantation.

LOL@Pam. They gonna have to get another slave cause I am NOT the one. Wait I've been working 9.5hrs already so maybe I am the one.
Naw Tee, they are not trying any flex time. No extra day off. They want to work us like dogs for no reason. The Sr. Manager was like I work 11hrs, and I'm like I bet you are making at least 20k more a year that I do as well.
I am not trying to be here until 6pm, especially not on a damn Friday. I mean come on. I have a life dammit!!!

See I try to stay non-exempt which means they have to pay me. They started that whole exempt BS so they could work folks longer. Here they put in about 10 hour days based on the fact that they can.
One time a sista during a fiscal year went non-exempt and started putting in her overtime. She was being paid an additional 40 hours a week sometimes! Then the boss ended up lobbying to get her back exempt.
A freaking shame.

I've heard of that - basically ways to crank out more man-power hours.

Sr manager is probably a salaried employee that makes alot more money...if you work more than 40 hours you will have to be paid overtime...lets see what tune changes then.

It varies from state to state.
In SC you are required to have at least one break (unpaid) every 6 hours. So working 10 or 12 hours is fine as long as the break is given.

Ok, exampt...how did I miss that little word? LOL sorry that word means all bets are off, and they can require whatever, that sucks.

This sounds like it is way too common. I mean we get breaks, but I'd rather just skip the break and go home.
I'm calling somebody on their asses. Who do we call for labor complaints?
Oh the big boss man who is so obviously is the reason behind this, routinely does not come to work or works less than 7.5hrs, I can't believe this shit.

There ya go, forward your resume, and set up an appointment, and get out quick.
Take your annual salary and divided it by 2080 = how much you make an hour.
now take your annual salary and divide it by 2176 = how much an hour you are not making.
If the recruiters can get you hella more then......fuck it you do that math.
Rock on.

Thanks Rock. I'll try those place, but they probably want someone with more experience than I have.
Oh I did not tell you that at the meeting that I said "well, I have to leave at a certain time in order to be at school even though I know school is almost over"
and she says "Well we already know about you, because you got this job contingent on you finishing your degree." And yes she said that with much attitude. So I guess I should keep stepping out at 4:30 period, bunk a 10hr timeline.
Uh, how is that anybody's business but mine? My mom says that I should have said something, but I'm like, uh, I don't know wtf her problem is but she definitely has one.

How about 'well it's a bit more stable than the acquisition of your job being based on your penchant for spectacular dick sucking"
but then you would really need Rocks answer, lol

You can also report them to the local EEOC if there is one in your area.
They have flex time where I work, but its voluntary. They also get a day off once every two weeks.
I work 7am to 3:30pm with 45 minutes for lunch. I never take the two 15 minute breaks because if I feel I need a break or need to go to the restroom, I just get up and go. Now, when I was working in claims, I did take my breaks. But the department I am in now, I am up and down so much, that I just go when I want.

LOL@Pam tryna get me in trouble.
Well I've been sending my resume out like a mad crazy woman and they are starting to bite too. Work does not seem as bad for some reason, hmmm. I have two interviews on Friday, one physical, one by phone. Maybe I should not go in at all that day.

That's why I turned down a request to move up to management in this retail gig. Thats when the hours don't matter, they press you for "the job", for the numbers to spike upward on paper, no matter how taxing it is.
Without a labor union, these companies feel free to make demands, and dare you to be the one to speak out in protest. Even with a union, they play with contract renewals, trying to starve you into a job action, forcing a confrontation until concessions are made. You think Human Resources is there to protect you? They want to keep the firm's ass covered. They get a whiff of you having a brain or spine of your own, retaliation will be the goal - its just a matter of how to mask it. Layoffs are always happening - all they have to do is fudge enough numbers to create some fiscal justification.
You don't have the pockets to wrangle with them legally, even if you're right, it had better be some blatant faux-pas like sex harrassment, something that might risk getting in the papers, or they'll tie you up in court just for spite to drain your $$.
At my last job, if I worked 7 to 4, nobody saw me the first two hours - they came in at 9 and everything is fine, what did they care how early I had to get there to prepare? But they have snide comments seeing me leave at 4, before them. And if I stayed late for receptions and teleconferences with the Asian markets, I would come in later. They go home at 5, and couldn't care less how late I was staying, but let me come through the door at 10am that day or the next, to compensate, and at looks like I'm slacking, on colored people's time - give you that look, then glance at the clock and back at you. I'm glad I was on late shift on 9-11 so I could turn my ass around on the NJ Turnpike. So many people that were caring more about what to do to close up the office, or finish a report while sirens were wailing because the corporate loyalty mindset was so ingrained, got caught wrong big time. I would have been right in there, trying to make sure the equipment was locked up and the voicemail changed....
