Well his child support just started back up... so after he pays what's owed in arrear's, he'll be caught up.

I don't think so. I would only ask for what the child is due. You did the right thing to do. What a good thing, the baby's father doing what is right--helping to take care of his kids.

Just a word of caution:
Switching children back and forth for tax purposes sends a red flag to the IRS that could cause you BOTH to be audited.
Since she lives with you he has no legal right to claim her, whether you allow him to or not. If audited you BOTH could be subjected to IRS penalties for filing a false claim.
And also if next year you decide to claim her (for whatever reason) your refund may be delayed or denied because the IRS will want to know where did this child came from.
I had several clients in my office this year that this happened to.

Thanks...
Since claiming her is of no advantage for me since I have two to claim already, we'll probably just continue doing it this way. That way they have nothing to flag :D

This happened to my cousin last year and this year. She had never had a job, and her mom was claiming her son and baby dad was claiming the daughter. She claimed both on her taxes last year and they held her refund until September, and will probably do the same this year.
