I don't think either party could be considered wrong.

If I'm the party arrested there is no law that says my mate has to know every detail of my life prior to meeting them. The arrest has no effect on today therefore is not an issue.

If I'm the party doing the check, the fact is we live in a society where people have to do things like this to protect themselves. As long as what is found out in the check is not cause for concern today it to is not an issue.
